These conditions of purchase apply to all sales of Protos brand items, which was conducted through Customer Service (hereinafter "CS") or through the website (the "website").

By placing an order, you warrant that you are over 18 and are lawfully able to study binding contracts.

We reserve the right to cancel fraudulent, false or speculative orders and orders that have been requested by a client when there may be a difference / dispute in past orders, or when there are reasonable doubts that might make us think that the customer is violating any of the conditions specified or is involved in any criminal activity.

1.1. User Obligations
As a user you are required to notify Protos all data needed for access and use of the services of this website. These must be truthful and current and consent that we may use them to get in touch with you if necessary.

It is essential to provide all the information classified as mandatory, and failure to do will mean we won't be able to complete the order. We will not be responsible in any way for any delays or failures in delivery resulting from errors or omissions in this data.

The user must make proper use of the services included on the website, always in accordance with the law and will not conduct any activity that interferes with or disrupts operation.

1.2. Security measures
We will establish all reasonable means at our disposal to ensure that your personal details are kept safe at any time. However, you agree that no data transmission over the Internet can be guaranteed to be secure from access by unauthorized recipients and we can not be responsible for any breach of security unless it is due to our negligence.

Also you must take the necessary security measures, both personal and material, to maintain the confidentiality of your username and password and immediately notify the loss, misplacement, theft, removal or unlawful disclosure of your username and password and their knowledge by third parties.

2.1. Purchase procedure
You can navigatethe website to find the desired item. Once located, clicking on it will access to all the information in detail offered by the website. From there you can add the item to your cart.

If you are placing an order for the first time with us, you are asked to register by entering your email address and password with which you can create and access to your account.

In the case concerned a registered user with an active account, you must enter your email and password and the system will recognize your data.

Once you are in your account you may continue to purchase and finally confirm the order.

2.2. Availability
All orders are subject to availability. We are not responsible for the lack of existence or unavailability of products.

If a product is unavailable after the order is placed, you will be informed as soon as possible by email or phone and this would be nullified.

If in doubt, we recommend contacting the CS.

2.3. Protos contract and acceptance of orders
The order will not be accepted by us until the amount has been charged to your account. After confirming the purchase, you will receive an e-mail acknowledging receipt, but this does not mean that the order has been accepted as subject to our subsequent verification and acceptance.

We will confirm acceptance of the order in an e-mail informing you that your order is being shipped. Only then the contract will be formalized between you and us, and only for items listed in the confirmation of dispatch.

2.4. Confirmation and cancellation of orders
Prior to the completion of the order for your part in the website, you can review all the details associated with it (amounts specified in all the necessary sections - taxes, transportation costs, selection of articles, etc.) being able to modify what you consider.

After the confirmation is not possible to modify or cancel the order through the website, you will have to contact the CS.

2.5. Money, tax and price
According to the law, the entire purchase from our website is subject to value added tax, except Canary Islands, Ceuta and Melilla. The applicable rate will be the prevailing (active) rate at all times.

In orders to the Canary Islands, Ceuta and Melilla, deliveries may be exempted from VAT, subject to the application of taxes and duties arising from the entry and exit of the product in those territories (official regulations), and should be paid directly by the client to the logistics operator responsible for the delivery.

All prices are in Euros (€) and should be considered as the final price paid by the client (including VAT or not depending on the territory of delivery, as shown in the previous paragraphs). Transport costs (if applicable) as well as taxes and fees for entry and exit of the product in Canary Islands, Ceuta and Melilla are not included in this price.

Purchases for the Canary Islands are exempt from Spanish VAT, but the customer must bear the taxes and costs for entry and exit of the product in Your Community (IGIC, customs clearance, etc.). These charges must be paid directly by the client to the logistics operator responsible for product delivery. Similarly, the customer shall bear the cost of disposal of the product of their community (customs clearance) when returning the order, plus the cost of shipping the package is made.

2. 6. Payment and Security
Any orders placed must be paid immediately after the order confirmation. Only those orders who have completed and verified payment will be extended.
Payment must be made by credit card and debit cards (issued by an entity with headquarters in Spain) or by bank transfer.

The order amount will be charged to your card, so you will have to tell us the number, expiration date and security code CW2 (included in the front). In case your card is Secure enabled, you will be asked to enter the relevant security code.

These data will not be stored or handled by us, but will be recorded directly to the payment gateway of the financial institution. For safety, we will use an Authentication Service for Secure Electronic Commerce, which was introduced by Visa / Mastercard / Eurocard, by which client authenticates to the issuer banks and trade authenticate to its acquiring bank.
The charge will be done in real time through the payment gateway. If the position can not be carried out finally (for any reason), the order will be automatically canceled.

2.7. Delivery: deadlines and problems
Delivery of orders will be made by a logistics operator during normal business hours at the address specified by you when ordering. If there is no one in that address when the logistics operator goes, this will leave a note and customer service department will attempt to contact you to agree another delivery.

The usual delivery time is about 1 to 3 working days after order approval in Spain and Portugal, being able to run 10 days outside Spain as long as there are no problems at customs if applicable. This period may increase in New Collection periods following fairs usually January and September, and it may be delayed until a month or if customs arrangements or other circumstances arising from (for information only) the geographical distance, weather conditions, war, strikes, any form government intervention, breach of our suppliers, etc. and any other attributable to the logistics operator responsible for product delivery. We are not responsible for delays that may arise from any of the reasons mentioned above.

If, at the time of receiving the package it is damaged, you will have to open it in the presence of logistics operator to check the status of the items. If damage is observed, this shall be detailed in the delivery note and contact the CS. We will repair or replace at no cost to you all those items that have been damaged or lost during shipment, when this incidence notify us as soon as possible. Please note that orders will be weighed for delivery prior to shipment.

Once delivered the order, it will become part of your property and therefore all damages that may arise will be your responsibility.
